Waiver

I. Release of Liability

In consideration of being allowed to participate in any way in the classes, events, and/or activities of

Krossface Jiu Jitsu:

1. Recognize and understand that martial arts training is an activity that involves physical contact and that my participation might result in serious injury, including permanent disability or even death, and severe social and economic loss.

2. Recognize and understand that such risk may be due to not only my own actions, but also the action, inaction or negligence of others, the regulations of participation, or the conditions of the premises, or of any of the equipment used.

3. Recognize that there may be other risks that are not known to me or to others or not reasonably foreseeable at this time.

4. Agree to inspect the facilities, equipment and pairings prior to participation. I will immediately inform an instructor if I believe that anything is unsafe or beyond my capability and refuse to participate.

5. Assume all of the foregoing risks and accept personal responsibility for any damages that may result from injury, permanent disability or death.

6. Enter martial arts training and/or competition entirely of my own free will and understand the importance of following the rules of training and competition.

7. I certify that I am in good physical condition, and have no disease, injury or other condition that would impair my performance or physical and mental well-being during intense training practice and/or competition.

8. Grant permission in case of injury to have a doctor, nurse, athletic training or other emergency medical personnel provide me with medical assistance or treatment for such injury.

9. Release, waive, discharge and covenant not to sue, Krossface Jiu Jitsu, its affiliated organizations and governing bodies, their officers, instructors and personnel, other members of the organizations, participants, supervisors, coaches, sponsoring organizations or their agents, and if applicable, owners and leasers of the premises from any and all liability to the undersigned, his or her heirs and next of kin for any and all claims, demands, losses and damages which may be sustained and suffered on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise.

I grant permission to Krossface Jiu Jitsu and its agents or employees, to use photographs taken of me or my minor child/children in classes or events of Krossface Jiu Jitsu for use in publications such as brochures, newsletters, and magazines, and to use the photographs on display boards, and to use such photographs in electronic versions of the same publications or on Krossface Jiu Jitsu web sites or other electronic form or media, and to offer them for use or distribution in other non-company publications, electronic or otherwise, without notifying me.

I hereby waive any right to inspect or approve the finished photographs or printed or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to me or unknown, and I waive any right to royalties or other compensation arising from or related to the use of the photograph.

I hereby agree to release, defend, and hold harmless Krossface Jiu Jitsu and its partners, owners, agents or employees, including any firm publishing and/or distributing the finished product in whole or in part, whether on paper or via electronic media, from and against any claims, damages or liability arising from or related to the use of the photographs, including but not limited to any misuse, distortion, blurring, alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution. 

I HAVE READ THE ABOVE WARNING, WAIVER, RELEASE OF LIKENESS, AND ASSUMPTION OF RISK. I FULLY UNDERSTAND ITS CONTENTS, AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. I HEARBY SIGN IT VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY.

III. COVID-19 WARNING & DISCLAIMER

I understand that COVID-19 virus has a long incubation period during which carriers of the virus may not show symptoms, can be highly contagious, and that it is impossible to determine who has COVID-19 and who does not given the current limits in virus testing. I understand that health authorities recommend social distancing as a mean to prevent the spread of the virus, and that Krossface Jiu Jitsu activities include physical contact with other participants.

I understand that participating in Krossface Jiu Jitsu activities could increase my risk of contracting COVID-19. I understand that contracting COVID-19 can potentially lead to severe illness, permanent disability, and even death. I understand that Krossface Jiu Jitsu will take reasonable precautionary measures, but cannot guarantee that COVID-19 infection will not occur through participation in Krossface Jiu Jitsu activities.

WAIVER, RELEASE AND INDEMNIFICATION

IN RETURN FOR MY PARTICIPATION IN KROSSFACE JIU JITSU ACTIVITIES, I ASSUME THE RISKS OF PARTICIPATION, EVEN IF ARISING FROM THE NEGLIGENCE OF KROSSFACE JIU JITSU OR OTHER PARTICIPANTS.

I understand that personal responsibility plays a key part in limiting the spread of COVID-19.

In an effort to reduce the possibility of infection, I agree not to attend Krossface Jiu Jitsu activities if I have any of the following potential symptoms of COVID-19 listed below and confirm that I am not currently presenting with any of the following symptoms:

• Fever

• Shortness of Breath

• Dry Cough

• Runny Nose

• Sore Throat

• Loss of Smell

• Loss of Taste

I agree that any dispute concerning, relating to, or referring to this Waiver shall be resolved exclusively by binding arbitration according to the then existing commercial rules of the American Arbitration Association in person in Contra Costa County, California, United States of America. Such proceedings will be governed by the substantive law of California. I understand that I am giving up any right that I may have to a jury trial or to bring claims in court against Krossface Jiu Jitsu.

In return for my participation in Krossface Jiu Jitsu activities, on behalf of myself, my heirs and representatives, I agree to INDEMNIFY, HOLD HARMLESS AND RELEASE Krossface Jiu Jitsu, its owners, employees, volunteers and representatives from any causes of action, claims, or demands of any nature whatsoever including, but not limited to, claims of negligence, now or in the future, against Krossface Jiu Jitsu on account of personal injury or even death, arising out of or related to Krossface Jiu Jitsu activities, whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of Krossface Jiu Jitsu or other participants.

Cancellation Policy
If you wish to cancel your membership, we require a 30-day notice. To submit a cancellation request, simply log in to your GymDesk account and follow the instructions to notify us of your intention to cancel.

• Payment processing: If your next payment is due within the 30-day period, it will still be charged.
• No refunds: Once you cancel, you will not receive any money back for unused time.
• If you cancel your Founders Membership and later rejoin Krossface Jiu Jitsu, the Founders Membership pricing will no longer be available.

Account Freeze Policy
We understand that life can get busy or circumstances may change. If you need to temporarily suspend your membership, we offer the option to freeze your account once per calendar year.

• 30-Day Notice: To freeze your account, we also require a 30-day notice. You can submit your freeze request through your GymDesk account.
• If you freeze your account, it can remain frozen for up to 2 months. After that period, you will be charged $40 per month.

Please keep in mind that the freeze option is available only once per calendar year. After the freeze period ends, your membership will automatically resume without any further action required on your part.

Late payments:

• Payments received more than 2 days after the agreed due date will incur a late fee of $20. All services may be suspended until payment is received in full.

I have full understanding of the nature and extent of the risks in Krossface Jiu Jitsu activities, and I am voluntarily assuming those risks.
